The process is conducted directly through a private arbitrator or through an organization such as the American Arbitration Association (AAA). Arbitration is generally faster but usually not cheaper than litigation--but it is a confidential proceeding. Privacy is many times the motivating factor for both sides. And the money result of a winning arbitration is enforceable in court if the prevailing party must enforce an arbitration decision.
